Mumbai Magistrate court on Friday rejected the bail applications of Aryan Khan and 2 others in the Mumbai cruise raid case stating that the applications were non-maintainable.

Aryan Khan, Arbaz Merchant and 6 others were sent to judicial custody for 14 days on Thursday. Aryan Khan, with the others accused, was transferred to the Arthur Road jail, and the women accused were sent to the Byculla Jail.

Aryan was arrested by the Narcotics Control Bureau (NCB) on October 3 after the agency busted a drugs party onboard a cruise ship off the Mumbai coast.

Advocate Satish Maneshinde, Aryan Khan’s lawyer while pleading his bail told the court that his client is from a respectable family, has roots in the society and won't run away. Maneshinde also presented a number of past judgements while making a case for Aryan Khan's bail.

He also contended the NCB's suspicion that Aryan can tamper the evidence if released on bail. "Just because a person belongs to an affluent family, you can't say he is likely to tamper evidence. There are people roaming streets with much more serious offences," said Maneshinde. "I have never used my influence," he added on behalf of Aryan Khan.

ASG Anil Singh for NCB argued that the maintainability of the remand application must be considered by the Court. Advocate Maneshinde, for Aryan Khan, rebuts, “In none of the cases decided in the past was the issue of maintainability raised by the NCB."

Maneshinde further said, "Especially since I (Aryan Khan) have not been found in possession of anything. My bail application was given in advance." The reply for the bail applications calls them “misconceived and not maintainable,” as quoted by Bar and Bench.

All of them have been booked under section 8C, 20B, 27 read with 35 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, after officers seized 13 gm of cocaine, 21 gm of charas (hasish), 22 pills of MDMA (ecstasy), 5 gm MD and cash worth Rs 1.33 lakh from the cruise ship.
