Modi govt. seeks opinion on Uniform Civil Code from Law Commission

Ahead of crucial assembly polls, in Uttar Pradesh and Punjab, the Modi government is trying to revisit the BJP’s once favourite uniform civil code agenda.

 

According to an Economic Times report, the Modi-led NDA government has asked the Law Commission to “examine” the controversial issue.

 

The reported move is likely to generate political debate on legal rights and secularism.


This is for the first time that the Modi government has sought an advice on the issue from Commission. The commission plays an advisory role for legal issues.

 

So far, a different set of personal laws – matters related to property, marriage, divorce, etc, apply to people based on the religion they practice. The implementation of the much controversial uniform civil code would mean the same set of personal laws would be applicable for all.

 

In the Indian Constitution, Article 44 of the Directive Principles states that implementation of uniform civil code is the "duty of the State". 
 

People who oppose the code often say particular social and religious practices would be compromised if such uniform treatment is implemented to all.

 

While for the BJP, the uniform code has been a major poll agenda, the Congress and other parties have opposed any such moves.

 

The report adds that the law ministry has written to the Law Commission for a detailed report.


A report would be submitted by the Commission after discussions with experts and stakeholders, the report said.
