Here's what will happen if Dileep is found guilty

  • ·         This means the actor will remain in jail for a longer period than just two weeks

If Dileep found guilty possibilities

Noted lawyer, K Ramkumar of Kerala High Court, who appeared for Dileep just hours after his arrest has already said that the actor was framed in actress attack case. Even, Dileep said that he was trapped and claimed to be innocent, as he was taken to the prison.

The actor was seen smiling and acknowledging the press on the way to the Aluva Police Club, where he was taken after questioning for five hours on Monday, and later shifted to Aluva Sub-jail. He seemed all confident to prove his 'innocence' as he always claimed even after the marathon questioning at the police club which had lasted for 13 hours.

Advocate Ramkumar, is known for his battle against the state in Rajan case, where he represented Rajan's father T V Eachara Warrier who fought against the then Chief Minister K Karunakaran. The former CM had to resign after facing allegations.

Interestingly, this is not the first time that Ramkumar has represented the actor legally. He had earlier represented Dileep in a defamation suit against Times of India. The actor had slapped a ₹50 crore suit against the newspaper for publishing a report which said the multiplex he was building in Chalakkudy was on encroached land.

Advocate Ramkumar was present at the residence of the magistrate when the actor was produced. He filed a bail application claiming that the charges under which the actor was booked are fabricated and weak, but the bench did not accept the arguments and sent the actor to 14-days judicial custody.

Advocate Ramkumar will file the bail application in court on Wednesday while the cops are planning to file an application demanding police custody for further questioning. It is sure that the court will witness arguments regarding his custody and bail.

However, Dileep's counsel said that the actor was booked under Section 120 (B), the punishment of criminal conspiracy, of IPC, which attracts a minimum punishment of six months and a maximum, death penalty. There is no doubt that the alleged offence committed by the actor, even if proved beyond doubt, will not invite death penalty.

It is to be noted that Pulsar Suni, the prime accused in the case, was charged under Sections 120 (B), 342 (wrongful confinement), 366 (Kidnapping, abducting or inducing woman), 376 (Punishment for rape), 506(1), 212 (Harbouring offender), 201 (Causing disappearance of evidence of offence, or giving false information to screen offender) and 34 (Acts done by several persons in furtherance of common intention) of IPC and Sections 66E (Punishment for violation of privacy) and 67A (Punishment for publishing or transmitting of material containing sexually explicit act) of the IT Act.

Legal experts state that Dileep being a part of conspiracy will be charged under same provisions as the conspirator is considered to have committed the same offence as the ones who carried out the plan.

As of now, Dileep is the 11th accused, but there are reports that he will be made the second accused once the charge sheet is filed. Under such circumstances, the prosecution can argue that the actor, if granted bail, is likely to tamper with the evidence and witnesses and even attempt to obstruct the investigation. If the case takes such a turn and the police, actually have all those 19 pieces of evidence, as they claim, against Dileep, then the once superstar could be seen behind bars for more than just two weeks.
