Is Dileep guilty? Here are the 'for and against' arguments made in court

Arguments for and against Dileep in court

The Kerala High Court has reserved its verdict in the bail plea submitted by actor Dileep. This is the second time that the court is postponing the case.
Dileep approached High Court on July 17, after the Magistrate court rejected his bail plea.

However, the court posted it on July 20 stating that it has to study the case. When the case was taken up on Thursday, both parties submitted their arguments. 

Here are the main contentions raised by both parties before the court, in arguments that lasted for over two-and-a-half hours. 

One: 

Prosecution:

The main contention of the Director General of Prosecution was that Dileep is the mastermind behind the entire incident, right from the conspiracy to the abduction and abuse of the actress that unfolded on February 17. He also submitted the case diary and said that the police got 19 pieces of evidence proving Dileep's role. The actor even tried to break the marriage of assaulted actress. 

Dileep's lawyer:

Advocate Ramkumar, the counsel of Dileep, argued that the police does not have any evidence against the actor. He also pleaded court to grant bail to the actor as the evidence collection has been completed. 

Two:

Prosecution:

Statements of all accused persons point to the involvement of Dileep. 

Dileep's lawyer

All persons arrested in the case are criminals while Dileep was never accused of a crime earlier. He was arrested solely on the basis of statements given by criminals. Confession of a criminal cannot be considered a valid evidence.

Three:

Prosecution

Dileep had repeatedly stated that he does not know Pulsar Suni, but there is evidence to prove that the actor met Suni four times and the two had spoken over the phone as well. 

Dileep's lawyer

There is no witness to prove that the duo met or what they discussed with each other. Police version that they were spotted together near the caravan of the actor does not prove that Dileep knew Suni in person. 

Four:

Prosecution 

Dileep transferred ₹10,000 to Pulsar Suni's account as an advance amount. Suni's mother's account was credited with ₹1 lakh, for which she failed to show source. 

Dileep's lawyer

Meeting between two persons cannot be considered as a conspiracy. The police have not proved beyond doubt that Dileep transferred the amount to the account of Suni's mother. 

Five:

Prosecution

Dileep knew about Suni's involvement in failed actress abduction attempt in 2011. There are eyewitnesses for Dileep's meetings with Suni. There is scientific evidence, like mobile tower location of both, to prove that the duo was in the same place on more than one occasion. They also held talks inside Dileep's caravan.

Dileep's lawyer

Meeting between two persons does not prove any previous links or business between them. Prosecution eyewitnesses did not hear the dialogues between actor and Suni. There is no witnesses or proof to establish that they were conspiring at the meeting. Mobile tower location cannot be considered as scientific evidence to prove the conspiracy. There is no witness to prove that the duo held talks inside actor's caravan.

However, prosecution strongly contended that granting bail to actor will affect further investigation as he is likely to tamper evidence and influence witnesses. The prosecution also said that this is the first time in Kerala history that a quotation was given for sexual assault.

The police also submitted the case diary and other evidence, to establish Dileep's involvement in the case, before the court.
