Kerala's first gay couple has moved the high court seeking to strike down certain provisions under the Special Marriage Act, 1954.
The Kerala high court has sought the views of Central and state governments on the writ petition of the petitioners.
In their petition, the gay couple said that the Special Marriage Act, 1954 provides rights to heterosexual couples to get married, but the right is denied for homosexual couples.
They added that their fundamental rights are denied and it is illegal and unconstitutional to an extent.
The petition was filed jointly by Nikesh Usha Pushkaran and Sonu MS who exchanged rings with the support of their families in 2018. However, their wedding hasn’t been legalised yet.
