The Karnataka High Court has ruled that a wife who earns more than her husband cannot automatically claim maintenance simply because she is a woman. The court said maintenance should be decided after examining the financial condition of both spouses and not on the assumption that a husband must always support his wife.

The ruling came while hearing a petition challenging a family court order that had directed a husband to pay his estranged wife ₹20,000 every month as interim maintenance, according to a report by the Times of India.

Husband Challenged the Family Court's Order

According to the case records, the husband argued before the High Court that his estranged wife was earning around ₹1 lakh per month, while his own monthly salary was ₹60,646.

He claimed that she was financially independent and capable of supporting herself. Therefore, he argued that there was no reason for him to pay interim maintenance.

The wife, however, told the court that she required financial support to repay debts that she had allegedly taken for her marriage. However, she did not submit details of the loans, pending payments or monthly instalments in support of her claim.

Court Rejects Gender-Based Assumption

Justice Chillakur Sumalatha allowed the husband's petition and set aside the family court's interim maintenance order.

The High Court observed that family courts should not assume that maintenance must always be granted to a wife simply because she is a woman.

The court said that where a wife is financially secure, earns more than her husband and does not have additional responsibilities such as caring for children, maintenance should not be awarded solely on the basis of gender.

The judge further observed that a spouse seeking maintenance must show that they are unable to maintain the same standard of living without financial assistance.

Income Difference Was a Key Factor

The court noted that the wife's admitted monthly income of ₹1 lakh was significantly higher than the husband's salary of ₹60,646.

It held that she was capable of maintaining herself and that requiring the husband to pay ₹20,000 every month in such circumstances was not legally justified.

As a result, the High Court declared the interim maintenance order unsustainable and set it aside.

Order Limited to Interim Maintenance

The High Court clarified that the ruling applies only to the interim maintenance order challenged before it and will not affect the final outcome of the matrimonial dispute.

The court also said the wife remains free to seek maintenance in the future if there is a significant change in her financial circumstances or other relevant factors.
