Prayagraj: The Allahabad High Court on Thursday stayed Varanasi civil court's order directing the Archaeological Survey of India (ASI) in a land dispute case related to conducting a comprehensive physical survey of the Gyanvapi mosque compound adjacent to the Kashi Vishwanath Temple in Uttar Pradesh.

Single judge Justice Prakash Padia said that the proceedings before lower court were prima facie bad in law, as the High Court was already seized of an issue relating to the dispute and had reserved its judgment on the same, according to Bar and Bench.

Significantly, the land title dispute relates to the Gyanvapi Mosque, allegedly built on the ruins of Kashi Vishwanath temple.

The Hindu community claims that the Mosque, which is situated adjacent to the Kashi Vishwanath temple, was built after demolishing a portion of the said temple, reported LiveLaw.

The Allahabad High Court had on March 15 reserved its judgment in various pleas, which had challenged the maintainability of the 1991 suit before the Varanasi trial court, seeking restoration of an ancient temple at the site where the Gyanvapi Mosque at Varanasi now stands.

The order was challenged by the Mosque's Anjuman Sanjharia Committee and the Uttar Pradesh Sunni Central Wakf Board in the High Court.

The plaintiffs, on behalf of the ancient idol of Swayambhu Lord Vishweshwar, had said that the Mughal ruler Aurangzeb in 1664 destroyed the temple and built a mosque on its remains.
