Supreme Court orders demolition of twin towers of Supertech in Noida within 3 months

FollowIn a setback to real estate major Supertech, the Supreme Court on Tuesday order to demolish the two 40-floor towers built by real estate company in one of its housing projects in Noida, upholding the an Allahabad high court order from 2014.

All flat owners of the twin towers in Emerald Court, Noida will be reimbursed along with 12% interest, the Supreme Court has ordered Supertech.
The bench of Justices DY Chandrachud and MR Shah ordered the demolition to be carried out within three months and under the supervision of NOIDA authority, LiveLaw reported.

“All flat owners in the twin towers in Noida to be reimbursed along with 12% interest and the Residents Welfare Association be paid Rs 2 crore for the harassment caused due to the construction of the twin towers," Supreme Court said in its order to Supertech.
Supertech Ltd had defended the construction of twin towers and claimed no illegality. It had said that Supertech had lost the case before the high court on two counts — distance criteria and for not taking consent of home buyers before constructing those towers.

The Supreme Court has further said that the consent of flat owners and RWA was necessary before the T16 and T17 towers were constructed in the Emerald Court.
