Delhi HC directs CBSE to decide on Class 10,12 examinations fee refund within 8 weeks

The Delhi High Court on Wednesday directed CBSE to treat the petition as representation and decide whether to refund, either wholly or partially, the examination fees taken.

Justice Prateek Jalan ordered the CBSE to decide within a span of 8 weeks on the petition by Deepa Joshi, mother of a Class X student at a school here, who had paid Rs 2,100 as fee.

Delhi High Court had observed that it cannot be argued that CBSE did not spend anything, it is still assessing students. It also came up with a formula to declare the results for Class 10 and 12 students. However, the course had also observed that some costs have been saved as the examinations were not conducted.

The decision from CBSE is likely to come soon. However, the court granted liberty to the petitioners to file a fresh writ petition if not satisfied with the decision taken by CBSE.

Advocate Rupesh Kumar submitted that CBSE was a self-financing body and its expenditure was principally funded by the examination fees collected from students appearing in class 10 and class 12 board examination.

He added that there was no direct correlation between the physical conduct of board examinations and fees charged from students.

The exams for Class X got cancelled on April 14 and the results are still not declared. The Class XII boards were cancelled on June 1.

The results of Class 10 and 12 CBSE students are likely to be announced on or before July 31, 2021. Earlier, the Supreme Court of India had directed all the boards across the country to publish their Class 12 results before July 31, 2021. Keeping that in mind, CBSE has already started the assessment procedures. Students must keep a check on the official website of CBSE, cbse.gov.in for more updates.
