Kerala: Activist Rehana Fathima moves SC in case over children painting on her semi-nude body
Rehana Fathima was booked by Kerala Police after a video of her two children drawing on her half-naked body started circulating on social media

Activist Rehana Fathima has moved the Supreme Court challenging the Kerala high court's judgement which dismissed her application for anticipatory bail.

On July 24, the Kerala HC refused her anticipatory bail after which Fathima approached the Supreme Court.

She was booked by Kerala Police after a video of her two children drawing on her half-naked body started circulating on social media.

The 34- year-old activist said that the video which is doing rounds on social media was made to highlight how women need to be open about sex and their bodies in a society where topics like sex and nudity are taboo. She added that these lessons should begin from one’s own home.

In the video, her son and daughter can be seen painting on her semi-naked body. The video was posted on social media on June 19. The video was captioned #BodyArtPolitics.

According to news agency Live Law, the HC had observed in its judgement that the video amounted to an obscene representation of children for the purposes of sexual gratification, attracting offences under Section 13 of the Protection of Children from Sexual Offences Act (POCSO) and section 67 B of Information Technology (IT) Act.

Fathima argued that nudity per se cannot be treated as obscenity. The petitioner quoted a Supreme Court precedent in the case of Aveek Sarkar vs State of West Bengal which held that only sex-related materials 'exciting lustful thoughts' can be regarded as obscene
