Is KJ George going to fight legally?

Questioning the order by Madikeri JMFC (Judicial Magistrate First Class) court, KJ George may file an injunction petition at the High Court of Karnataka or may file a petition at JMFC court itself to reconsider the matter.

 

Sources say that the Congress has already contacted Ram Jethmalani, Supreme Court lawyer, to take up the case, and a petition will be filed within 2-3 days.

 

The CID has taken over the case and the government has ordered a judicial enquiry in this matter. It is left to the decision of the CID investigation officer on whether to arrest George under Section 306, which deals with abetment to suicide. George, however, can apply for anticipatory bail to avoid being arrested.  

 

CM Siddaramaiah has refuted these speculations and has said that KJ George has resigned on moral grounds. The CM is holding a press meet at around noon today to offer clarifications to the rumours of George’s arrest.    

 

K J George resigned on Monday shortly after a court directed the police to register an FIR against him and two top police officers in connection with alleged suicide of DySP MK Ganapathy.

 

George's exit came within hours after a local court at Madikeri in Kodagu district gave the direction on a private criminal complaint filed by the deceased police officer Ganapathy's son Nehal requesting it to direct the police to take up investigation against the minister and two officers for allegedly abetting his father's suicide.

 

Also, senior IPS officers Pranab Mohanti and AM Prasad, who were accused in Ganapathy's video message, have filed a stay order in the High Court challenging the JMFC's orders. The two senior policemen claim that there were no documentary evidence to support Ganapathy's claims.

 

The duo have submitted a petition to the High Court single bench which mentions that Ganapathy's family didn't seek permission from authorities before lodging a private petition.
