Serial killer Cyanide Mallika death's sentence cancelled, retrial ordered

Synopsis

The Karnataka High Court has dismissed the death sentence awarded to Cyanide Mallika. Cyanide Mallika had taken one Nagalakshmi K of Doddaballapura out on the pretext of taking her to a temple. She took her to a deserted place and fed her cyanide and killed her. She then took away all the jewels and fled. A retrial has been ordered and files returned by the HC

The Karnataka High Court has dismissed the death sentence awarded to Cyanide Mallika by the Bengaluru Rural District Chief and Sessions Court for killing and robbing a woman and ordered retrial, reported Kannada Prabha.

A bench headed by Justice Ravi Malimutt and Justice John Michael Cunha  heard the Criminal Referred case appealing for endorsing the death sentence awarded by the Bengaluru Rural Sessions Court and the appeal Mallika had submitted requesting cancellation of death sentence.

Cyanide Mallika had taken one Nagalakshmi K of Doddaballapura out on the pretext of taking her to a temple. She took her to a deserted place and fed her cyanide and killed her. She then took away all the jewels and fled.  The Bengaluru Rural Chief and Sessions Court heard the case and sentenced Mallika to death.  

After hearing the case, the HC dismissed the death sentence stating that the Sessions court had passed the judgement without allowing the Public prosecutor to conduct cross examination of Dr Ashwath Narayan who had conducted the autopsy of the deceased Nagalakshmi. This is incorrect. Hence a retrial has been ordered and files returned.  It has also ordered that the doctor must be called for cross examination of Sept 30 and the case must be concluded with by Jan 31, 2018.
