High Court not happy with Dileep's fifth bail petition

  • The bench observed that the plea can be considered only if the situation has changed considerably

Dileep has approached the High Court seeking bail for the fifth time, and the court has deferred the plea for hearing on September 26. However, while considering the plea, the bench asked why the actor has approached the court once again, as the same bench had cancelled his bail petition twice.

Without giving an opportunity for Dileep's counsel to present his arguments, the court observed that the only change it noticed is that the remand period of the actor has been extended. The bench also noted that the probe is still on and the Special Investigation Team (SIT) has not finished interrogation of Kavya Madhavan and director Nadirshah.

The court pointed out that the bail can be considered, only if there are substantial changes in the circumstances. 

The actor is claiming that he has the right to get bail since he has served 71 days in remand. He also alleges that Manju Warrier is very close to ADGP Sandhya, who is in the SIT probing the case and that director Shrikumar Menon has rivalry towards him. The actor further submitted that he has never tried to influence the witnesses and that cinema projects worth over ₹50 crore is pending since he is in jail. 

However, the court sought the opinion of prosecution and posted the case for hearing on September 26. Rejecting the bail plea submitted by Dileep, Angamaly Magistrate Court had on September 18 said that the accused could be let off on bail by default only if the police fail to file the charge sheet within 90 days. The court also observed that Dileep is equally responsible for all the crimes committed by Pulsar Suni in actress attack case.

Dileep will have to face the trial of the case from jail if the High Court denies bail to the actor for the third time and police files charge sheet within 90 days. The SIT is planning to file the charge sheet before October first week.
