2-year-old molested me, says 35-year-old woman

Synopsis

A 35-year-old woman has alleged an infant has outraged her modesty and stole her gold chain.  Section 82 of IPC specifically stated that - Nothing is an offence which is done by a child under seven years of age. 

 

In a surprising incident a two-year-old boy has been accused of outraging a woman's modesty. The incident happened in Motihari district of Bihar. An FIR has been registered at Patahi police station in which a 35-year-old woman has alleged that the infant has outraged her modesty and stole her gold chain. Only the name of the child had been mentioned. 

According to a daily's report, the child is scared and has become subdued with all the noise this incident has raked up. He, along with his father are in danger of being arrested by the police. However, as per the Indian legal system, a child under the age of seven can’t be prosecuted because no act is considered an offence done by a child below seven. Section 82 of IPC specifically stated that - Nothing is an offence which is done by a child under seven years of age. 

To get the child’s name removed from the FIR, his father met the station house officer (SHO) who refused to do so and asked the father to surrender in court; the Deccan Herald quoted the father as saying. 

Meanwhile, the SHO said that the age of the accused is not mentioned while lodging a complaint and he suggested the father to meet senior police officers. It is suspected that the woman lodged the FIR due to some enmity with the family of the child.
