
In a striking ruling, the Madhya Pradesh High Court dismissed a woman’s appeal against a family court decision granting her husband a divorce on grounds of mental cruelty. The husband accused his wife of engaging in inappropriate WhatsApp conversations with her male friends, a claim backed by chat records presented in court.
A division bench of Justices Vivek Rusia and Gajendra Singh ruled that spouses must maintain dignity in their interactions with friends of the opposite gender, reports Bar and Bench. "No husband would tolerate his wife indulging in such vulgar chatting," the court remarked, emphasizing that despite objections, the wife's continued behavior amounted to mental cruelty.
The couple, married in 2018, faced discord early on. The husband, who is partially deaf, claimed that his wife began mistreating his mother soon after the wedding and eventually left their matrimonial home. He further alleged that she continued conversations with former lovers, producing WhatsApp messages as evidence.
The wife, however, contended that her husband had hacked her phone and fabricated the messages. She accused him of domestic violence and demanding a dowry of ₹25 lakh, but the court found no official complaints or FIRs to support her claims.
The High Court took note of the wife’s father’s admission that she habitually chatted with male friends. The court found that the chat transcripts presented were indeed indecent and upheld the family court’s ruling, concluding that the husband had proven mental cruelty.
“The respondent has certainly made out a case of mental cruelty. The appeal is liable to be dismissed,” the bench ruled, sealing the husband’s divorce victory.
