Kerala High Court has rejected Dileep's bail plea stating that the most crucial material evidence, the mobile phone, is yet to be recovered. Pronouncing its statement, the court said that the case is unique considering the seriousness, meticulous planning, cruel execution and being a crime execution to wreak vengeance on a woman by engaging criminals to sexually abuse her. 

"The mobile phone used for recording the sexual assault and the memory card in which the video graphed materials are stored have not been recovered," the bench said.
It also said that "the memory card is a potential threat to the life of the victim and there is every possibility of any of the accused attempting to interfere in the investigation and prosecution with the card."

On considering the arguments raised by opposition Judge Sunil Thomas found that it is too early to grant bail to Dileep and hence dismissed the petition.
