Supreme Court to hear petition today challenging Triple Talaq

The apex court today will hear the petition of a Muslim woman, who challenged the practice of triple talaq. The woman, Ishrat Jahan is challenging that annulment of marriage using talaq questioning the constitutional validity.

Jahan is seeking that the Supreme Court declares that Section 2 of the Muslim Personal Law (Shariat) Application Act, 1937 as unconstitutional. Jahan in her says that it violates fundamental rights provided by the constitution (Articles 14 (equality), 15 (non-discrimination), 21 (life) and 25 (religion).

The lady is questioning that such a unilateral divorce deprives a woman of her conjugal rights and also weakens her position when she demands the custody of her children.

A series of similar petitions would be heard by Chief Justice of India TS Thakur.

The All India Muslim Personal Law Board will have to speak in front of bench about its opinion and stand.   

Earlier on July 29, the court had sought a larger debate on the petitions.

According to a DNA report, the president of the All India Muslim Women Personal Law Board (AIMWPLB) is also supporting doing away with the triple talaq.
