'We can't stop it': SC refuses to stay proceedings against Gautam Gambhir's procurement of Covid medicines

Synopsis

The Supreme Court further said: "This is not done. We do not want to say anything but we also have our ears to the ground."  

The Supreme Court on Monday refused to stay the proceedings against BJP MP Gautam Gambhir's foundation in a case relating to illegal procuring and distribution of COVID medicines. 
A two-judge bench of Justices DY Chandrachud and MR Shah said that people were running around for medicines and drugs, and suddenly, in this situation, a trust comes and says we will give you medicines. 

The court further said: "This is not done. We do not want to say anything but we also have our ears to the ground." 

'We cannot stop it. You proceed with your remedy before the High Court. Cannot allow a trust, or group of people, to distribute medicines, while people run helter-skelter for drugs. An individual cannot distribute medicines... Then everybody will procure and distribute for their own purpose," the court added.

Senior advocate Kailash Vasdev, appearing for the foundation, sought a stay on the prosecution under the Drugs and Cosmetics Act. Earlier, the Delhi government's drug controller informed the Delhi High Court that Gautam Gambhir Foundation has been found guilty of unauthorisedly stocking, procuring and distributing the Fabiflu medicine to COVID-19 patients. 

The court slammed the foundation and said genuine patients who needed the medicine at that particular time could not get it as the bulk stock was taken away by cricketer-turned-politician Gambhir.
