SIT to probe Naval Wife Swapping case, orders Supreme Court

According to a report the Supreme Court yesterday instructed to set up a special investigation team (SIT) to look into the allegations of wife-swapping among Indian Navy Officers. The Kerala police will set up the SIT, led by a deputy inspector general rank officer

The order comes after the estranged wife of a Naval Officer had demanded a CBI probe before a Supreme Court bench. The bench headed by Chief Justice of India T S Thakur, however, rejected the plea.

“It is well-settled that the extraordinary power of the constitutional courts in directing CBI to conduct investigation in a case must be exercised rarely in exceptional circumstances, especially, when there is lack of confidence in the investigating agency, or in the national interest and for doing complete justice in the matter,” the bench said as reported by the news daily.

“The facts and circumstances in which the offence is alleged to have been committed can be better investigated by the state police,” said the bench, after taking into account an argument by the Kerala Police that 70 witnesses had already been examined in the matter.

The woman got married to the officer in 2012 and after a year, their relationship started to turn sour. In addition to levelling allegations against her in-laws and husband of torture she also accused five naval officers of wife-swapping.

The estranged wife in her appeal was seeking investigations against four Naval officers in addition to her husband, accusing them of wife-swapping.

The victim was also seeking transfer of the case from Kerala High Court to Delhi High Court, fearing influential naval officers might divert the due investigations, which was also rejected by the court.

As per court’s directions, a senior advocate appointed by the Kerala Legal Services Authority will pursue her case.
