Rajasthan Speaker has said he has asked his lawyers to file a special leave petition (SLP) in the Supreme Court against the HC order to defer action.
Jaipur: Amid the ongoing tussle between Rajasthan chief minister Ashok Gehlot and Sachin Pilot, Speaker CP Joshi said he will approach the Supreme Court against the high court’s order asking him to defer action against Sachin Pilot and other rebel Congress MLAs.
Speaker CP Joshi said Rajasthan was heading to constitutional crisis and to prevent that, he will move the Supreme Court.
“The Speaker has the complete authority to send a show-cause notice. I have asked my counsel to file a Special Leave Petition (SLP) in Supreme Court,” CP Joshi said.
Adding further, he said, “Only the Speaker has the right to disqualify MLAs as in 1992, a constitution bench said that the court will not interfere in such actions.”
Joshi alleged that the authorities' rightful division of powers was being circumvented by the matter reaching High Court, calling it a "constitutional crisis".
Meanwhile, after Rajasthan high court deferred action against revel MLAs, “Speaker CP Joshi has postponed the further course of action in connection with disqualification notice sent to 19 MLAs till the evening of 24th July,” said Rajasthan Assembly Secretariat.
In a relief for the Sachin Pilot camp, the Rajasthan high court has requested the assembly speaker to defer action on disqualification notices to dissident Congress MLAs till July 24.
Rajasthan plunged into a political crisis after chief minister Ashok Gehlot's deputy Sachin Pilot rebelled along with 18 other MLAs. The Congress later sacked Pilot from his deputy chief minister post and also as the party's state unit head.
