
FIR has been filed against Assam Chief Minister Tarun Gogoi yesterday following a press conference called by him against the Election Commission directive. The press conference is a violation of model code of conduct. The section 126 of the Representation of the People Act does not allow display of “any election matter by means of television or similar apparatus” within 48 hours of voting.
Gogoi held a press conference while the second and final phase of polls was underway on 11 April.
If proven guilty in a court of law, a person has to undergo two years imprisonment or penalty. Gogoi also might have to step down from his seat if proven guilty.
The second phase witnessed 85% voters turn-out. Results would be declared 19 May.
