A plea has been filed before the Bombay High Court asking for an order to restrain and put a stay on the release of the film titled 'Nyay, the Justice' made on the life of late actor Sushant Singh Rajput.
The plea is filed by one Manish Mishra, who is said to be an ardent Sushant Singh admirer and a believer of the government of Maharashtra.
In the plea, the plaintiff has challenged an interim order of the Mumbai City Civil Court at Dindoshi refusing to grant a permanent injunction against the release of the film.
The matter was however moved to Justice PK Chavan on Wednesday, but was delayed as no urgency was found in the same till first week of March.
According to Mishra's argument, the film producer Sarla Saraogi is trying to malign the reputation of the present State government by alleging that it failed to take proper steps to investigate the death of Sushant.
The plaintiff also claimed that he is emotionally attached to SSR.
Saraogi has however opposed the contention of Mishra by stating that he has no locus standi to file the case as it is premature and the film is not released yet.
Earlier, ad-hoc Judge SN Salve of the City Court, while refusing interim relief stated that Mishra failed to show his personal interest in the matter and hence injunction cannot be granted.
Judge Salve has said that it is difficult to hold that the contents of the film to malign the reputation of the late actor and the present State government.
The City Civil Court gave a reason that Mishra has failed to establish how he would suffer any loss if the film is released, in case injunction is refused, the prayer for injunction was declined.
