
The Supreme Court has upheld the Rajasthan High Court's July 8, 2026 judgment in a long-standing seniority dispute involving School Lecturers appointed through the 2015 recruitment process, bringing relief to around 11,000 lecturers.
A bench of Justice KV Viswanathan and Justice Arun Palli dismissed a batch of Special Leave Petitions challenging the Rajasthan High Court judgment after hearing the parties at length.
The Supreme Court, after examining the records and the High Court's judgment, said it found "no good ground to interfere" with the impugned judgment and orders. The SLPs were accordingly dismissed.
The dispute concerns the determination of seniority among School Lecturers selected through the same recruitment process but appointed on different dates.
According to the case of the affected lecturers, the 2015 recruitment was conducted for around 13,000 posts across 19 subjects. While candidates in some subjects were appointed in October 2016, appointments in certain other subjects were made in June 2017 following legal complications and litigation.
The lecturers have contended that the later appointment of candidates in some subjects was not attributable to them and that they should not lose seniority merely because their appointments were delayed due to litigation.
The principle being relied upon by the affected lecturers is that candidates selected through the same recruitment process should be treated on a common footing for seniority purposes, rather than being disadvantaged because their appointment orders were issued at a later stage.
The issue has also had implications for promotional opportunities. The affected lecturers have argued that differences in seniority arising from different appointment dates resulted in candidates selected through the same recruitment process receiving unequal promotional opportunities.
The Rajasthan High Court's Division Bench had earlier ruled on the issue in its judgment dated July 8, 2026. The judgment was subsequently challenged before the Supreme Court through multiple SLPs.
The petitioners before the Supreme Court were represented by Senior Advocates Kapil Sibal, Mukul Rohatgi, Shyam Divan, Gopal Sankaranarayanan and S Gurukrishnakumar, along with Advocate-on-Record Tanvi Dubey and other counsel.
The respondents were represented by Senior Advocates V Giri, Paramjit Singh Patwalia and Dr. Manish Singhvi, along with Advocate-on-Record Aditya Giri and other counsel.
The Supreme Court's dismissal of the SLPs leaves the Rajasthan High Court judgment undisturbed. The Court also directed that all pending applications, if any, would stand disposed of.
The decision is expected to pave the way for implementation of the High Court judgment and further proceedings concerning the common seniority of the School Lecturers covered by the recruitment.
The matter had been under litigation since 2022, with the affected lecturers seeking removal of the disparity arising from different dates of appointment despite their selection through the same recruitment exercise. (ANI)
