The Centre is all set to move an Ordinance to implement the Triple Talaq Act. The bill was passed by Lok Sabha by voice vote but stalled at the Rajya Sabha due to a protest by the Opposition parties. The Opposition is demanding to refer the issue to a Select Committee for scrutiny.

The Ordinance on Triple Talaq will make the instant Talaq a punishable offence, and one can be sentenced to 3-year-jail term. Instant talaq will also be a cognisable and a non-bailable offence. Thus with this Ordinance, instant talaq which is proclaimed verbally, through writing or electronic form will be termed illegal.

A committee comprising Home Minister Rajnath Singh, Finance Minister Arun Jaitley, Law Minister Ravi Shankar Prasad, Minority Affairs Minister Mukhtar Abbas Naqvi was formed by the Modi government to draft the bill on triple talaq.

The bill was presented and passed in the Lok Sabha on December 28, last year. The bill also gives the provision to the victim of triple talaq (wife) to seek allowance and custody of her minor children. The victim can approach the magistrate court for justice. 

The Supreme Court verdict had declared in August last year that the practice of instant talaq is illegal. However, as reported in the Economic Times, currently 177 cases regarding triple talaq are pending in the Supreme Court, and 67 cases were reported after the verdict.
