First Kerala gay couple moves high court to strike down Special Marriage Act

A gay couple from Kerala has moved the high court seeking legalisation of same-sex marriages. In their petition, the gay couple said that the Special Marriage Act, 1954, provides rights to heterosexual couples to get married, but the right is denied for homosexual couples.

They added that their fundamental rights are denied and it is illegal and unconstitutional to an extent.

The petition was filed jointly by Nikesh Usha Pushkaran and Sonu MS who exchanged rings with the support of their families in 2018. However, their wedding hasn’t been legalised yet.
