Abhishek Banerjee’s defamation case against Amit Shah transferred to Kolkata court

TMC MP Abhishek Banerjee's defamation suit against Union home minister Amit Shah was sent to the Metropolitan Magistrate Court in Kolkata by a designated court for MPs and MLAs on Monday (February 22).  

Advocate Brajesh Jha, in his submission, drew court’s attention that the address used in the summon was of Murlidhar Len, which is not the residential address of Amit Shah but of the BJP office. The judge then decided to send the case to the Metropolitan Magistrate Court.

At a public meeting on Mayo Road in Kolkata on August 11, 2018, Shah had alleged that the people of Bengal did not receive the Centre’s funds because of “corruption” by Chief Minister Mamata Banerjee and her nephew Abhishek.

Abhishek Banerjee filed a case against Amit Shah in the wake of this statement. Two days ago, Amit Shah or his representative was ordered to appear in court by 10 am on Monday.

Abhishek sent a legal notice to Shah, demanding an apology from him for the allegation. The notice reads, “In the course of your speech you had made various allegations against my client by making a flimsy and thinly veiled reference and/or insinuation to the ‘bhatija’ (nephew) of the Hon’ble Chief Minister of the State of West Bengal.”

A fortnight later, a case was filed under IPC section 500 (defamation). Trinamool claims that BJP leaders do not have the courage to name Abhishek Banerjee. So, they made imaginary allegations against him by calling him ‘Bhaipo’. This time he had to take a legal step.
